Court Strikes Down Federal Obamacare Subsidies

In a potentially lethal blow to Obamacare, a federal appeals court has ruled that the federal government may not subsidize health insurance plans bought by people in states that decided not to set up their own marketplaces under Obamacare. The law clearly says that states are to set up the exchanges. But 34 states opted not to, and the federal government took over in those states. The court ruled that federal government may not pay subsidies for insurance plans in those states.

"We reach this conclusion, frankly, with reluctance," District of Columbia Appeals Court judge Thomas Griffith writes in the 2-1 ruling, which the federal government is almost certain to appeal to the Supreme Court. ... "At least until states that wish to can set up Exchanges, our ruling will likely have significant consequences both for the millions of individuals receiving tax credits through federal Exchanges and for health insurance markets more broadly," Griffiths wrote.

The administration says 6.7 million people are getting tax credits to pay their premiums for insurance policies on the exchanges. Of these, 70 percent, or 4.7 million, are using a federal exchange.

COURT DEALS POTENTIALLY HUGE BLOW TO OBAMACARE

AP - A federal appeals court has thrown out an IRS regulation that implements key subsidies for health insurance under the Affordable Care Act, dealing a potentially significant blow to the law.

The lawsuit is viewed as the most potentially damaging challenge to the law since the 2012 lawsuit targeting Obamacare's individual mandate to purchase health insurance. Handing out subsidies to lower-income people is one of the most basic functions of the law, and helps provide otherwise unaffordable health insurance. If federal subsidies are ruled illegal, it could torpedo the law — not to mention wreak havoc on the subsidies already dished out.

"If the courts took the argument seriously, it could seriously damage the implementation of the Affordable Care Act," Timothy Jost, a law professor at Washington and Lee University and a supporter of the law, told Business Insider earlier this month. "It has the potential to destroy the individual insurance market in two-thirds of the states."

Appeals Courts Disagree Over Obamacare

Obamacare got taken for a roller-coaster ride on Tuesday when two different appeals courts took completely different takes on the latest challenges to the law.

In a potentially lethal blow, a federal appeals court in Washington, D.C. ruled that the federal government may not subsidize health insurance plans for people in 34 states that decided not to set up their own marketplaces under the law.

But the 4th U.S. Circuit Court of Appeals in Richmond took the opposite point of view, saying the subsidies are legal.

Years of more court action likely lie ahead before the matter is settled.

Federal Court Throws Out Obamacare Subsidies Ruling

In a victory for the Obama administration, a federal appeals court in Washington, D.C. Thursday threw out an earlier ruling that said financial subsidies are not available for people who bought health insurance on the federal exchange. A three-judge panel of the D.C. Court of Appeals reached that conclusion in late July. On the same day, a federal appeals court in Richmond reached the opposite conclusion and said the subsidies are available.

But Thursday, the full D.C. Court of Appeals said it will re-hear the case, which erases the lower court ruling that went against the subsidies.
