Federal Judge: Guillotine 'Probably Best' for Executions

A federal appeals judge issued a blistering dissent in a death-row case on Monday, declaring that an execution system that relies on drugs is doomed and the guillotine would be better.

"Using drugs meant for individuals with medical needs to carry out executions is a misguided effort to mask the brutality of executions by making them look serene and peaceful — like something any one of us might experience in our final moments," Judge Alex Kozinski of the Ninth U.S. Circuit Court of Appeals wrote.

"But executions are, in fact, nothing like that. They are brutal, savage events, and nothing the state tries to do can mask that reality. Nor should it. If we as a society want to carry out executions, we should be willing to face the fact that the state is committing a horrendous brutality on our behalf."

A little known bit is history is that Hitler used the Guillotine to execute thousands. Of course beheading is the favorite means of execution among many Islamist groups too.

But speaking to the Judge's point, I've often wondered why should society be any less brutal executing those who have commuted heinous than the criminals were to their victims? Personally, I would favor a military style firing squad. Of all the methods, that one has the least likelihood of not working - and its pretty cheap compared to other means. The shooters are also generally quite moved by the experience. Even as society should be reluctant to employ Capitol Punishment except when the crime warrants it as the only solution and every legal defense has been exhausted.

I mostly agree with what you are saying.

The only real objection that I have to capital punishment is that no matter how good the evidence is, there is always the chance (however small) that the wrong person was convicted.

An innocent man sent to prison can be freed and some degree of restitution made when the truth comes out, but an innocent man who was executed can not be brought back to life.

On the other hand, if I were falsely convicted of a crime I hadn't committed, a quick death might be preferable to many years living in a cage. :shrug
