New Bill Would Let FTC Regulate Photoshop

Looking too good could literally become a crime under newly proposed federal legislation, which would give the Federal Trade Commission power to regulate Photoshop image editing software use in advertising and other media.

The Truth in Advertising Act of 2014 or “Anti-Photoshop Act” was introduced in the U.S. House of Representatives earlier this year by Florida Republican Rep. Ileana Ros-Lehtinen along with Democrats Lois Capps of California and Theodore Deutch of Florida. If enacted, the bill will empower the FTC to regulate and reduce the use of Photoshopped images in media.

“The Truth in Advertising Act has already sparked more awareness of the need to address the unrealistic body image often promulgated by advertisers,” Ros-Lehtinen said in a statement, adding she’s “hopeful that this bill will get the hearing it deserves.”

Well, Adobe Photoshop can be used for that. It is also used to make advertised food look better and many other things. There's hardly a published magazine photo that hasn't been P'shopped But I've heard nobody complain about those.

I use Photoshop to manipulate digital images to create texture maps to make 3D digital CAD models look more real. I've used 3D imaging tools both professionally and personally. One can make a proposed room addition look almost real. Also the 3D Video Game industry would be adversely affected should the Government overreach in this area.

I really hate to see the Federal Law impinge too greatly on technology. Sure some people may feel misrepresented in photos. I get that. But professional models are paid for most of the pictures Companies use in advertising. The contracts the models sign allow the Companies to use photos of them in various ways. And owners that legally buy commodities have rights too. Shouldn't the lawyers be able to protect their clients through contractual agreement, rather than to expect the Federal Government to make another Law that can be manipulated to suppress technology and prosecute the innocent?
